A federal court judge has ruled that a federal court's order denying a request for a preliminary injunction barring the marketing of certain drugs to consumers has invalidated a complaint filed by a former owner of Nexium, a popular heartburn medication.
The plaintiff, Zagreb, who is also a plaintiff in the case, sought a preliminary injunction prohibiting the marketing of the drug, Prevacid, to consumers in the state of South Africa, where he has been living for more than a decade.
"The ruling of the court was based on the view that the plaintiff did not intend to challenge the injunction," Zagreb's lawyer, Michael D. Gagel, toldThe Associated Press.
"You're saying that, based on my view of the plaintiff, he was not doing what he was claiming," he said.
He said that since he was a plaintiff, he was able to demonstrate to the court that he did not intend to challenge the injunction.
