A federal court judge has ruled that a federal court's order denying a request for a preliminary injunction barring the marketing of certain drugs to consumers has invalidated a complaint filed by a former owner of Nexium, a popular heartburn medication.

The plaintiff, Zagreb, who is also a plaintiff in the case, sought a preliminary injunction prohibiting the marketing of the drug, Prevacid, to consumers in the state of South Africa, where he has been living for more than a decade.

"The ruling of the court was based on the view that the plaintiff did not intend to challenge the injunction," Zagreb's lawyer, Michael D. Gagel, toldThe Associated Press.

"You're saying that, based on my view of the plaintiff, he was not doing what he was claiming," he said.

He said that since he was a plaintiff, he was able to demonstrate to the court that he did not intend to challenge the injunction.

He said that he and his partner, the plaintiff's father, have had a long-standing relationship with the defendant, which is in South Africa, for nearly 20 years.

"He has been in the country for about 10 years. We are now in the same relationship," he said.

He said he believes the injunction was valid and he will appeal.

Zagreb's lawyer has argued that the plaintiff's remedy is to have the plaintiff produce a complaint on behalf of the defendants. The plaintiff's complaint does not argue that the plaintiff is a plaintiff, he said.

"You don't need to be a plaintiff to be able to show that. The plaintiff's complaint is that he is not doing what he is alleged to be doing," he said.

The plaintiff is seeking injunctive relief against the defendant's marketing practices.

He said that it would be the plaintiff's burden to demonstrate that the defendants engaged in deceptive practices. The plaintiff is seeking the defendants' consent to the use of the defendant's drug, Prevacid.

"The plaintiff's action was not brought by a third party because he was not a plaintiff," he said.

The plaintiff's complaint also seeks a permanent injunction that would prohibit the defendant from marketing Prevacid, which is available in Canada, and would prohibit the defendant from selling Nexium, a widely used drug used to treat gastroesophageal reflux disease (GERD).

The plaintiff's request for a preliminary injunction is predicated on the plaintiff's failure to produce a complaint on behalf of the defendants.

The plaintiff filed his complaint after his father died in 2001, and the plaintiff's son was injured when his mother was allegedly injured.

In the past, the plaintiff's father had used Nexium and Prevacid to treat his heartburn.

The plaintiff's father died from cancer following a lung transplant and his son was diagnosed with heartburn in August 2002.

His father also suffered from chronic pain from ulcers, and his father died in 2009 after he was hospitalized for an infection.

In August 2009, the plaintiff's son was diagnosed with chronic acid reflux disease.

His son's cancer continued to recur after he was diagnosed with a severe allergic reaction.

In April 2010, the plaintiff's father received treatment for GERD from a gastroenterologist.

In June 2010, the plaintiff's son was diagnosed with a type of heartburn that has been reported to have been caused by prescription Nexium and Zantac. The plaintiff's son is recovering in South Africa.

The plaintiff's son's cancer was also reported to have been caused by a drug, Prevacid, used to treat GERD, which was manufactured by the company Pfizer.

In April 2010, the plaintiff's son was diagnosed with esophagitis.

In August 2009, the plaintiff's son was diagnosed with gastroesophageal reflux disease.

In March 2010, the plaintiff's son was diagnosed with severe heartburn that had been caused by a prescription drug, Zantac.

The plaintiff's son's cancer had also been caused by the same drug, Prevacid, and was also reported to have been caused by a drug, Zantac.

In August 2009, the plaintiff's son was diagnosed with esophagitis.

In April 2010, the plaintiff's son was diagnosed with esophageal cancer.
